Man sues Planet Hollywood for assault after being frightened by mannequin in his room

A man claims he was seriously injured after attempting to escape his darkened Planet Hollywood hotel room when an unexpected mannequin caused him to panic back in 2015.

The mannequin was inside a glass case and displaying a racing suit, but according to a lawsuit filed on Monday, Kent Boutwell believed that it was a person who intended to harm him.

"The presence of a life-sized human figure in a darkened room was a dangerous and/or hazardous condition," the lawsuit alleges. The filed lawsuit claims that Planet Hollywood was negligent by failing to "place signs, caution, warn, or otherwise make safe" the hazardous condition caused by the mannequin's presence.

Along with the claims of negligence, the lawsuit says that Planet Hollywood committed assault on Boutwell, since the resort "created the situation that caused Plaintiff to feel apprehension of harmful or offensive contact." This situation reportedly resulted in serious injuries, some of which the lawsuit claims are“permanent and disabling.”

Casaers Entertainment released the following statement:

"While we do not comment on pending litigation, historically many of the Planet Hollywood rooms were decorated with memorabilia which has been removed during a $125 million full modernization and renovation of all 2,496 rooms."
