The 40-year-old man accused of murder in the death of a 3-year-old appeared in court Monday after failing to appear last week.

Joshua Oxford is facing murder charges in the death of 3-year-old Daniel Theriot. He's the boyfriend Cassie Smith, Daniel's mother.

Police found Daniel's body in a remote area near Lake Mead after Smith reported the child missing at Sunset Park.

Oxford is a co-defendant in the case with Smith. He was arraigned Monday in court, telling Judge Melanie Tobiassian that he understood the charges against him. Monday’s appearance comes after he did not show in court last week with Smith.

Oxford is expected to return to court on November 26. Smith is expected to be back in court for a preliminary hearing on September 20.
